1.About these Terms
FitCash is operated by 9537-2058 Québec Inc. ("FitCash", "we" or "us"). By creating an account or joining a challenge, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use FitCash.
These Terms don't take away any rights you have under consumer protection laws that can't be excluded by contract.
2.Who can use FitCash
- You must be at least 18 years old, or the age of majority where you live if that's higher.
- Taking part in paid contests of skill must be legal where you live. Paid challenges are void where prohibited, and we may block them in any region.
- You may have only one account, and it can't be shared or transferred.
We may ask you to verify your identity, age or location, for example before a withdrawal.
3.How challenges work
Before you join a challenge, the app shows you the exercise, the daily target, how many days it runs and the entry fee. Everyone in a challenge pays the same entry fee.
You must hit the daily target in the app, using the camera rep counter, before 11:59 p.m. in the time zone recorded when you joined, on every day of the challenge. The rep count recorded by the app is the official count.
If you miss a day, you're out and you lose your entry fee. The same happens if you leave early or are disqualified. Only stake what you can afford to lose.
4.The pot, the fee and payouts
When a challenge ends:
- Everyone who finished gets their full entry fee back.
- FitCash keeps 25% of the forfeited entry fees as its fee. We never take a fee from a finisher's own stake.
- The other 75% of the forfeited entry fees is split equally between everyone who finished, rounded down to the cent.
If everyone finishes, everyone gets their entry fee back and FitCash takes nothing. If nobody finishes, FitCash keeps the whole pot.
Example. 100 people join with a $10 entry fee, and 30 miss a day. That's $300 forfeited. FitCash keeps $75 (25%), and the remaining $225 is split between the 70 finishers: $3.21 each. Each finisher gets $13.21 back.
5.Payments and withdrawals
- Entry fees are paid through our payment processor, Whop.
- Payouts go into your FitCash wallet. You can withdraw once your balance is at least $10, to PayPal or as a gift card through Tango.
- FitCash doesn't charge a withdrawal fee, but PayPal may charge its own fees. Gift cards can't be exchanged or refunded once issued.
- We may hold a withdrawal while we verify your identity or review your account for cheating.
- You're responsible for any taxes on your winnings.
6.Refunds
Entry fees are not refundable, except in these two cases:
- A medical condition, with proof. If an injury or illness stops you from safely completing a challenge, email us a note from a licensed healthcare professional confirming you couldn't safely exercise on the relevant dates. Send it before the challenge ends or within 14 days of the day you missed. If we approve it, your entry fee goes back to your wallet.
- FitCash cancels the challenge. If we cancel a challenge, everyone's entry fee goes back to their wallet.
We don't give refunds for any other reason, such as changing your mind, forgetting, travel, phone problems or reps that weren't counted.
7.Fair play
Every rep must be done by you, live, in front of your own camera. Using someone else to do your reps, fake or recorded video, modified apps, multiple accounts, or any other way to cheat is not allowed. Harassing other users or posting offensive content isn't either.
If we find you've cheated, we may disqualify you, cancel your winnings (including ones already paid), and close your account.
8.Health and safety
FitCash is not medical advice. Check with a doctor before starting any exercise program, and stop immediately if you feel pain or discomfort. No stake is worth an injury. You take part at your own risk.
9.Your account
You can delete your account at any time in the app or by emailing us. Withdraw your balance first. If you delete your account during a challenge, you lose that entry fee.
We may suspend or close your account if you break these Terms. If we close it for a reason other than cheating or fraud, we'll pay out your remaining balance.
10.Liability
FitCash is provided "as is". We don't guarantee that it will always be available or that rep counting will be error-free. To the extent the law allows, we're not liable for indirect losses, and our total liability is limited to the entry fees you paid in the 12 months before the claim.
This doesn't limit our liability for bodily injury caused by our fault, or anything else the law doesn't allow us to limit.
11.Changes to these Terms
If we make an important change to these Terms, we'll tell you at least 30 days before it takes effect. If you don't agree, you can close your account. Changes never apply to a challenge you've already joined.
